In these Terms and Conditions:
Your use of CheckMate.ID’s service is voluntary. These Terms and Conditions govern your use of CheckMate.ID’s service, including your use of the CheckMate.ID API. You authorize CheckMate.ID to provide the Merchant with: (1) verification of your identity and (2) verification and analysis of your bank account and financial information.
You may access and use the CheckMate.ID API for the purpose of identity and financial information verification. By accessing and using the CheckMate.ID API, you agree to be bound by these Terms and Conditions. If you do not agree, do not access or use the CheckMate.ID API.
You represent and warrant to CheckMate.ID that you have the legal right to access and use the CheckMate.ID API for the purposes outlined in these Terms and Conditions. You agree to comply with all applicable laws, rules, and regulations in your use of the CheckMate.ID API and not to use it in a manner prohibited by law or in violation of any contractual provision by which you are bound.
By using the CheckMate.ID API, you consent to the collection, use, and transmission of your data, including personal and financial information, as necessary for the purposes of identity verification and financial analysis. You authorize CheckMate.ID to retrieve, process, and store such data and to share it with the Merchant as necessary to fulfill the service.
You may not use the CheckMate.ID API for any purpose other than the intended and authorized uses described in these Terms and Conditions. You agree not to interfere with or disrupt the API or the servers or networks connected to the API, or to disassemble, reverse engineer, or decompile the API or any software, code, or technology associated with the API.
You are responsible for maintaining the confidentiality of any access credentials or API keys provided to you. You are solely responsible for all activities that occur using your access credentials or API keys, whether or not authorized by you.
You agree to comply with all applicable data protection laws and regulations, including those concerning the collection, use, and storage of personal data. CheckMate.ID will process your data in accordance with its Privacy Policy, which you agree to by using the API.
In no event will CheckMate.ID, or its distributors, suppliers, or any related entities, be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the CheckMate.ID API, even if advised of the possibility of such damages. CheckMate.ID’s total cumulative liability under these Terms and Conditions shall not exceed the lesser of $10.00 CDN or the revenue actually received by CheckMate.ID directly attributable to your use of the API.
CheckMate.ID reserves the right to terminate or suspend your access to the API at any time, with or without cause, and without prior notice. Upon termination, your rights to use the API will immediately cease.
The laws of British Columbia, Canada will govern this agreement, without reference to conflicts of law principles. The parties hereby submit to the jurisdiction of the provincial and federal courts in British Columbia, Canada.
CheckMate.ID reserves the right to modify these Terms and Conditions at any time. The most current version will be available on our website, and by continuing to use the API after any changes, you agree to the updated Terms and Conditions.
